Contest Rules

The Players NIL Inc. Student Athlete Voice Over Competition

Interested student athletes may submit a video to be considered for a paid corporate video voiceover position.

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.

1. Eligibility
The Players NIL Inc. Student Athlete Voice Over Competition (the “Contest”) is open to student athlete legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old at the time of entry and not a minor in their state of residency. Individuals who enter the Contest pursuant to Section 5, Contest Entry-How to Enter, below and Section 3, Agreement to Official Rules, (“Contestants”) must have legal authority to enter into this Contest at the time of submission. Employees of The Players NIL Inc. and other companies associated with the promotion of the Contest, and their respective parents, subsidiaries, affiliates and advertising and promotion agencies as well as their immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The Contest is subject to federal, state, and local laws and regulations.

2. Sponsor
The Contest is sponsored by The Players NIL, Inc., located in Redondo Beach, California. The Players NIL Inc., shall be referred to herein as either “The Players NIL Inc.”or “Sponsor” herein.

3. Agreement to Official Rules
Participation in the Contest constitutes Contestant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein.

4. Contest Period
The Contest begins on May 4, 2022 at 12:01 am and ends on May 18, 2022 at 11:59 pm (the “Contest Period”). Submissions will be accepted online at The Players NIL Inc. website only for the duration of the Contest.

5. Contest Entry – How to Enter
Potential Contestants may enter the Contest online only by visiting the The Players NIL Inc.’s website at https://theplayersnil.com/talent/ and following the directions provided to fill out and submit both 1. the entry information, (“Entry Information”), and 2. the submit a qualifying video submission, (“TPNIL Video Submission”), which together shall be jointly referred to as the ( “TPNIL Submission”).

Limit one (1) TPNIL Submission per person, per email address. Entries received from any person or e-mail address in excess of the stated limitation will be void. All TPNIL Submission entries become the property of The Players NIL Inc and will not be acknowledged or returned.

6. Winner Selection
On or about May 18, 2022, The Players NIL Inc. will select up to five (5) potential winners from among all eligible TPNIL Submissions received. The odds of being selected depend on the number of entries received. The Players NIL Inc. will attempt to notify the potential winner via telephone or email on or about May 19, 2022. If the potential winners cannot be contacted within five (5) days after the date of the first attempt to contact him/her, The Players NIL Inc., may select an alternate potential winner in his/her place from the remaining non-winning, eligible TPNIL Submissions.

7. Winner Notification
The potential winners will be notified by email, mail or phone. Each potential winner will be required to complete, electronically sign and submit a TPNIL Voice Over Agreement within five (5) days of the date notice or attempted notice is sent, in order to claim his/her TPNIL Prize. If a potential winner cannot be contacted, or fails to submit the TPNIL Voice Over Agreement within the required time period, the potential winner shall forfeit the TPNIL Prize. Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, The Players NIL Inc. will award the applicable TPNIL Prize to an alternate winner from among all remaining eligible TPNIL Submissions.

8. Prizes
Those winners selected shall receive the “TPNIL Prize” as follows;

A TPNIL student athlete voice over paid position which shall include the following:

  1. Three hundred dollars ($300)
  2. (1) Free Five Pillars Course
  3. Free subscription to The Players NIL Newsletter
9. General Conditions
In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including, but not limited to fraud, virus, bug, worm, unauthorized human intervention or other technical problem, or in the event the Contest is unable to run as planned for any other reason, as determined by The Players NIL Inc. in its sole discretion, The Players NIL Inc. may, in its sole discretion, either (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules or (b) terminate the Contest and, in the event of termination, award the TPNIL Prize from among the eligible, non-suspect TPNIL Submissions received up to the time of the impairment. The Players NIL Inc. reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, The Players NIL Inc reserves the right to seek damages (including attorney’s fees) and any other remedies from any such person to the fullest extent permitted by law. Failure by The Players NIL Inc. to enforce any provision of these Official Rules shall not constitute a waiver of that provision.

10. Collection and Use of Information/Privacy Policy/Terms and Conditions
The Players NIL Inc. respects your privacy, and we want you to understand how we may collect personal information about you through our website and how that information may be used, maintained and, in some cases, shared. Information collected from Contestant is subject to The Players NIL Inc.’s privacy policy, found on The Player’s NIL Inc.’s website. “Personal information”, is any information that enables us to identify you, directly or indirectly, by reference to an identifier such as your name, identification number, location data, online identifier or one or more factors specific to you. Personal information includes “sensitive personal information” and “pseudonymised personal information” but excludes anonymous information or information that has had the identity of an individual permanently removed.

BY USING OR ACCESSING THE PLAYERS NIL INC.’S WEBSITE OR BY PROVIDING PERSONAL INFORMATION TO US ON OR THROUGH THE WEBSITE, YOU CONSENT TO THE COLLECTION, USE, TRANSFER AND DISCLOSURE OF THAT INFORMATION IN ACCORDANCE WITH THE PLAYER’S NIL INC.’S WEBSITE’S TERMS AND CONDITIONS, PRIVACY POLICY AND APPLICABLE LAW.

11. Video and Image Consent and Release
As consideration for and by participating in this Contest, effective as of the date of TPNIL Submission, Contestant hereby grants The Players NIL Inc., present and future approval and permission to use the image, picture or voice recording arising out of Contestant’s TPNIL Submission as set forth below in this Section 11, Video and Image Consent and Release.

Contestant hereby grants to The Players NIL Inc. and its agents, employees, licensees, and successors in interest (collectively, the “Released Party”) all ownership rights and the absolute and irrevocable right and permission to copyright, use and publish the Contestant’s recorded image and/or voice as part of the TPNIL Submission (the “Submission Image and/or Voice”).

The Submission Image and/or Voice may be copyrighted, used and/or published individually or in conjunction with other photography, video works, and recordings, and in any medium (including without limitation, print publications, public broadcast, CD-ROM format) and for any lawful purpose, including without limitation, trade, exhibition, illustration, promotion, publicity, advertising and electronic publication.

The Contestant represents and warrants that (i) no other party has been granted an exclusive license with respect to the Submission Image and/or Voice, and (i) no other party’s authorization or consent is required with respect to the permission granted to The Players NIL Inc. under this Section 11, Video and Image Consent and Release.

Contestant further waives any right that Contestant may have to inspect or approve The Players NIL Inc.’s use of the Submission Image and/ or Voice, or the advertising copy or printed matter that may be used in connection with the use and/ or publication of the Submission Image and/or Voice. Contestant releases The Players NIL Inc. (and all persons acting under its permission or authority) from all claims for libel, slander, invasion of privacy, infringement of copyright or right of publicity, or any other claim related to the Submission Image and/or Voice (collectively, “Image and/or Voice Claims”). This release includes without limitation any Image and/or Voice Claims related to blurring, distortion, alteration, optical illusion, digital alteration, use in composite form, whether intentional or otherwise, or use of a fictitious name, that may occur or be produced in the processing or publication of the Submission Image and/or Voice.

CONTESTANT WARRANTS THAT CONTESTANT HAS READ THIS CONSENT AND RELEASE PRIOR TO THE TPNIL SUBMISSION AND THAT THE CONTESTANT UNDERSTANDS IT, AND THAT THE CONTESTANT FREELY ENTERS INTO THIS CONSENT AND RELEASE.

12. Release and Limitations of Liability
By participating in the Contest, Contestant agrees to release and hold harmless the The Players NIL Inc. the Released Parties from and against any claim or cause of action arising out of participation in the Contest or receipt or use of the TPNIL Prize (including any travel or activity related thereto), including, but not limited to: (a) any technical errors associated with the Contest, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Contest; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d) application downloads, (e) any other errors or problems in connection with the Contest, including, without limitation, errors that may occur in the administration of the Contest, the announcement of the winner, the cancellation or postponement of the event and/or the flyover, if applicable, the incorrect downloading of the application, the processing of entries application downloads or in any Contest-related materials; or (f) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from Contestants participation in the Contest or acceptance, receipt or misuse of the TPNIL Prize (including any travel or activity related thereto). Contestant further agrees that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Contest, and in no event shall the Contestant be entitled to receive attorney’s fees. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Contestant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

13. Disputes
Except where prohibited, Contestant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any TPNIL Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in California. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Contestant’s rights and obligations, or the rights and obligations of The Players NIL Inc., in connection with the Contest, shall be governed by, and construed in accordance with, the laws of California, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than California.

In the Legal, Tax, and Compliance course, student-athletes will learn important business skills and NIL-related regulations they will need to follow. Valuable tax-related information is also included as navigating taxes as an independent contractor or starting a business can be tricky for young adults.

Influencer and Brand Relations teaches student-athletes how to determine and increase their value to potential partners, negotiate deals, and commons mishaps to look out for.

In our Personal Brand Development course, student-athletes will learn why it's necessary to build your own personal brand, as well as actionable steps to take to get started. We'll also go through managing your image and controlling your narrative across multiple platforms, and critical mistakes to avoid along the way.
